Press Statement Against Unlawful Deportations

A press statement was issued in response to the ongoing unlawful practices targeting refugees and migrants, particularly the unjust detention and deportation of Taha Elgazi and his wife in our country.

Declaration Text

To the Esteemed Authorities of the Ministry of Interior,

This statement is the collective voice of a community that has come together to demand an end to the ongoing unlawful practices targeting all refugees, migrants, and asylum seekers—beginning with the unjust detention and deportation of Taha Elgazi and his wife.

Since 2019, we have witnessed—and continue to witness—numerous cases of unlawful detention, surveillance, and deportation of migrants carried out by Provincial Directorates of Migration Management and Removal Centers under the Directorate General of Migration Management. Despite individual voices raised against these injustices and the reactionary and denial-based press releases issued by the Directorate in response, no effort has been made to correct these practices. This lack of reform shows that, without intervention, such systemic injustices will continue, which forms the primary basis of this statement.

Taha Elgazi and his wife, who have been actively resisting these injustices from the beginning, are yet another example of this injustice, having been unlawfully deported. We stand with Taha Elgazi and bear witness to his struggle—and to those who have wronged him. This unlawful act against him and his family, along with similar injustices suffered by many others, highlights the need to address the structural problems within the Directorate of Migration Management. We hereby reiterate our demand for reform.

This structural issue has evolved into a generalized pattern of unlawfulness, applied indiscriminately to all individuals, and manifests in practices that threaten the right to life, personal security, and human dignity. These include: the rejection or non-processing of lawful applications by Provincial Directorates on arbitrary grounds; the arbitrary detention of migrants either during legal processes or within daily life; the forced deportation of individuals from Removal Centers who do not voluntarily wish to return and are awaiting judicial outcomes, often under psychological or physical duress; the intentional prolonging of procedures to compel migrants to leave—even when doing so places them at risk in their countries of origin—and numerous other practices that violate Law No. 6458.

The Constitutional Court has issued key rulings recognizing the right to protection against refoulement as a constitutional right through the individual application mechanism. These decisions emphasize that migrants’ fundamental rights cannot be arbitrarily violated by administrative practices and highlight the urgent need for effective oversight mechanisms. However, the failure to implement these rulings and the persistence of unlawful practices show that the structural problems remain unresolved. As a result of such practices, Taha Elgazi and his wife have been unjustly deported.

Our demands are as follows: the injustice against Taha Elgazi must be reversed; all unlawful practices targeting migrants must be immediately halted; administrative procedures must be brought in line with the law; those responsible for these unlawful actions must be held accountable through legal means; and independent monitoring mechanisms must be established to oversee the process. We affirm our commitment to continue following this issue until justice is restored for Taha Elgazi and these practices comply with the law.
